Minutes

 

CALL TO ORDER

 

Mayor Fred Waterman called the meeting to order at 6:00 P.M. and led the Pledge of Allegiance and Moment of Silence.  Councilman Delgado dedicated the Moment of Silence to all our military, police or fire who are protecting us through the Holiday Season.

 

ROLL CALL

 

Present were:  Mayor Fred Waterman, Vice Mayor Michele Kern, Council Members Xavier Bedolla, Roy Delgado, Rick Monzon and Tensi Reed, City Manager BJ Cornwall, Attorney Fredda Bisman, City Engineer Chris Young, Interim Police Chief Bryan Beamish, Captain Juan Rodriguez and City Clerk Edith Hoover.

 

CONSENT  AGENDA

 

Consideration and action regarding the second reading of Ordinance O05-12-19, amending the zoning ordinance map and rezoning all lots on Honcho Road from Thunderbird Road to Grand Avenue from R-4 Mobile Home Residential Zone to R-1a Single Family Residential Zone.

 

Consideration and action approving Resolution R05-12-36, declaring as a public record that certain document titled “Chapter 11, Offenses” of the City Code.

 

Consideration and action approving Ordinance O05-12-20, adopting the codification of that certain document titled “Chapter 11, Offenses” of the City Code.

 

Consideration and action approving the February 24, 2005 Regular Council meeting minutes.

 

Consideration and action approving Resolution R05-12-37, declaring as a public record that certain document titled “Chapter 16, Sewer” of the City Code.

 

Consideration and action approving Ordinance O05-12-21, adopting the codification of that certain document titled “Chapter 16, Sewer” of the City Code.

 

Consideration and action approving Resolution R05-12-38, declaring as a public record that certain document titled “Chapter 20, Nuisance” of the City Code.

 

Consideration and action approving Ordinance O05-12-22, adopting the codification of that certain document titled ‘Chapter 20, Nuisance” of the City Code.

 

Consideration and action approving the FY05/06 Fire Department Memorandum of Understanding.

 

Councilman Delgado made a motion to approve all items listed on the Consent Agenda; seconded by Councilman Monzon.

EXECUTIVE SESSION

 

Councilman Delgado made a motion to convene into Executive Session; seconded by Councilwoman Reed.

                     Motion:           Carried

                    

Discussion and consultation with the City’s attorney for legal advice and to consider the City’s position and instruct its attorneys regarding pending litigation: City of El Mirage v. Glendale, CV2005-009579.  A.R.S. 38-431.03(A)(3) and (4).

 

Councilman Delgado made a motion to close the Executive session and reconvene into Regular Session; seconded by Councilwoman Reed and Councilman Monzon.

MAYOR’S COMMENTS

 

Mayor Waterman wished everyone a Safe and Happy Holiday!

 

REGULAR AGENDA

 

Consideration and action approving Resolution R05-12-39, calling upon the City of Glendale to permit property owners self-determination regarding their future.

 

City Manager BJ Cornwall reported this resolution basically is saying they should lift the strip annexation so the landowners can go where they want to go.  The City of Glendale has had this area striped for twenty seven years and have provided any improvements or services to these people.  This would give the landowners freedom of choice.

 

Vice Mayor Kern made a motion to approve Resolution R05-12-39, calling upon the City of Glendale to permit property owners self-determination regarding their future; seconded by Councilman Delgado.

COUNCIL SUMMARY OF CURRENT EVENTS

 

No Council comments were received.

 

CITY MANAGER SUMMARY OF CURRENT EVENTS

 

Mr. Cornwall read a letter regarding Lorenzo Aguirre from the Census staff thanking them for exceptional service for the Maricopa County Special Census.  The staff went above and beyond to provide exceptional service to not only them but to the citizens of El Mirage.

 

Mr. Cornwall wished everyone and Safe and Happy Holiday Season!

 

CALL TO THE PUBLIC

 

“Ah, yes, Sir, actually I am not here on the behalf of the public, I am here on behalf of the labor union…the firefighters local 4361.  Ah, my name is Mark Bessey, I am representative OF Local 4361 for the El Mirage Firefighters’ Association.  Honorable Mayor, Madam Vice Mayor, Distinguished members of the Council, ah, it is with great displeasure that I have to come to talk with you tonight.  Ah, as you are well aware, our contract was due to be signed over six months ago and it was finally brought up on the agenda tonight.  During the time of the negotiations, our negotiations were hostile to say the least.  We were met with immature and irresponsible rhetoric.  On several occasions the negotiations were delayed and delayed and delayed.  The members of the El Mirage Local 4361 are not asking to have our cake and eat it too.  We are only asking for the fair things that we have been promised three years ago.  We are asking for a slight increase in firefighters pay  to bring us up even with the rest of the valley and we are asking for the 25 cents an hour that we were promised three years ago for paramedic pay.  While we understand the City is in a state of fiscal reconstruction, we believe that great things are around the corner and we want to be a part of this change.  We don’t want to be another third party entity coming in to provide services to the City of El Mirage without an interest.  We want to be here to help facilitate the change.  To the members of the Council, I would like to thank you for your undividing….undying commitment to our community and your selfless efforts and I do believe strongly that together we can make El Mirage a stronger, safer, more fiscally sound community.  Thank you.”

Councilman Delgado made a motion to adjourn at 6:21 P.M.; seconded by Councilwoman Reed.
